Introduction

These Terms and Conditions ("Terms") govern the use of SAF Planet B.V. ("SAF Planet") services, including but not limited to the purchase, procurement, and retirement of Sustainable Aviation Fuel credits ("SAF credits"), as facilitated through our website, safplanet.earth (the "Website"). By accessing or using our services, you ("Customer") agree to be bound by these Terms.

Definitions and scope of service

  • SAF Credits conform to the definition of ‘intangible environmental credits’

  • Service execution: SAF Planet will procure and retire SAF credits on behalf of the Customer to achieve agreed emission reductions. This retirement process will be executed via a SAF registry adhering to stringent guidelines, safeguarding the credibility of the SAF transaction. Credits will be retired in SAF Planet’s name by default, unless otherwise agreed. SAF Planet commits to fulfilling the service through the procurement and retirement of certified SAF or SAF credits within a reasonable period of time

  • The SAF that is procured and retired does not guarantee that the SAF will be physically allocated to the Customer’s specific flight or travel. Rather, the SAF is allocated and utilized within the broader aviation supply chain, contributing to overall reductions in aviation-related CO₂e emissions. This approach still achieves the intended emission reduction impact, in line with the environmental objectives underlying the SAF credit purchase.

  • Procurement source: SAF Planet reserves the right to procure SAF credits from any qualified source, provided the delivery aligns with these Terms. 

  • Carbon Intensity (CI) values: Conversion of physical SAF to emission reduction CO₂ figures may be based on actual Life Cycle Emission data or default values as per CORSIA guidelines.

Limitation of service:

  • SAF procured via SAF Planet is designed to only serve voluntary emission reduction purposes. These credits are not designed, certified, or intended for regulatory compliance purposes.

  • SAF credits, categorized as 'scope 3 credits' cannot be applied toward airline operator emission reduction claims (regulatory or voluntary). SAF credits, categorized as 'scope 1 credits' cannot be applied toward business/organization emission reduction claims.

  • If a business elects to procure and use these credits to reduce its greenhouse gas (scope 3) emissions or to achieve regulatory or voluntary emission reductions targets (such as, but not limited to, Science Based Targets), it does so at its own discretion and risk.

Warranties and disclaimers

  • No warranty of usage: SAF Planet and its affiliates, subsidiaries, or agents make no representation, warranty, or guarantee concerning the use of its services for any particular purpose by the Customer.

  • Accuracy of information: SAF Planet makes every effort to provide accurate and complete information regarding SAF credits and services. However, should the Customer share or utilize SAF credits for any purpose or with any third parties, SAF Planet disclaims liability for the accuracy, completeness, or suitability of the information.

Limitation of liability and indemnification

  • Indemnification: To the fullest extent permitted by law, the Customer agrees to indemnify, defend, and hold harmless SAF Planet, its officers, employees, agents, and affiliates from and against any claims, actions, proceedings, losses, damages, costs, or expenses arising out of or related to any use of SAF credits, reliance on provided information, or breaches of these Terms.

  • Limitation of liability: SAF Planet shall not be liable for indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of use, or loss of data. SAF Planet's liability for any claim shall not exceed the amount actually paid by the Customer for the SAF credits in question.

  • Third-party use: SAF Planet disclaims liability for any outcomes arising from the unauthorized use or transfer of SAF credits to third parties or for purposes other than as intended in these Terms.

Third-party applications and use terms

Any third-party services used in delivering SAF credits (e.g., registries, verifiers) are not under SAF Planet’s control, and SAF Planet is not liable for issues arising from these services.

Dispute resolution and governing Law

In case of a dispute, SAF Planet encourages initial resolution via mediation or arbitration before resorting to court proceedings. All disputes shall fall under the exclusive jurisdiction of the courts in Amersfoort or Utrecht (Rechtbanken Midden-Nederland), the Netherlands.

Changes to terms and conditions

SAF Planet reserves the right to amend or modify these Terms at any time. Notice of such changes will be posted on the Website, and continued use of the service following any changes constitutes acceptance of the new Terms. Customers who disagree with any updates may terminate their use of the service.

Electronic communications clause

By using SAF Planet services, Customers consent to receive necessary service-related communications, updates, policy changes, and marketing messages. Customers can manage communication preferences anytime through their account settings on the Website.

Entire agreement and modification clause

These Terms constitute the entire agreement between SAF Planet and the Customer, superseding any prior agreements. Any amendments to these Terms must be made in writing and communicated electronically or on the Website.

Algemene voorwaarden SAF Planet B.V.

Inleiding

Deze algemene voorwaarden ("Voorwaarden") zijn van toepassing op het gebruik van de diensten van SAF Planet B.V. ("SAF Planet"), waaronder, maar niet beperkt tot, de aankoop, inkoop en afboeking van Sustainable Aviation Fuel credits ("SAF credits"), zoals gefaciliteerd via onze website, safplanet.earth (de "Website"). Door onze diensten te gebruiken, gaat u ("Klant") akkoord met deze Voorwaarden.

Definities en reikwijdte van de diensten

  • Uitvoering van diensten: SAF Planet zal namens de Klant SAF credits inkopen en afboeken om overeengekomen emissiereducties te realiseren. Dit proces wordt uitgevoerd via een SAF-register dat strenge richtlijnen volgt om de geloofwaardigheid van de SAF-transactie te waarborgen. Credits worden standaard ingetrokken op naam van SAF Planet, tenzij anders overeengekomen. SAF Planet verbindt zich ertoe de dienst binnen zes (6) maanden na aankoop van de Klant uit te voeren via gecertificeerde SAF of SAF credits.

  • Fysieke toewijzing: De ingekochte en afgeboekte SAF garandeert niet dat de SAF fysiek wordt toegewezen aan de specifieke vlucht of reis van de Klant. De SAF wordt toegewezen en gebruikt binnen de bredere luchtvaart toeleveringsketen, wat bijdraagt aan de algehele reductie van luchtvaartgerelateerde CO₂e-emissies. Deze aanpak realiseert nog steeds de beoogde emissiereductie, in lijn met de milieudoelstellingen achter de aankoop van SAF credits.

  • Bevestiging: De factuur van de Klant dient als bevestiging van de inkoop van SAF credits. Aanvullende bevestiging is op verzoek beschikbaar.

  • Inkoopbron: SAF Planet behoudt zich het recht voor om SAF credits van elke gekwalificeerde bron in te kopen, mits de levering in overeenstemming is met deze Voorwaarden.

  • Koolstofintensiteitswaarden: Conversie van fysieke SAF naar CO₂-emissiereductiecijfers kan gebaseerd zijn op werkelijke gegevens van levenscyclusemissies of standaardwaarden volgens CORSIA-richtlijnen.

Beperkingen van de dienstverlening

  • De via SAF Planet ingekochte SAF is uitsluitend bedoeld voor vrijwillige emissiereductie doeleinden. Deze credits zijn niet ontworpen voor gebruik bij naleving van regelgeving.

  • SAF credits, gecategoriseed als 'Scope 3', kunnen niet worden gebruikt voor emissiereductieclaims van luchtvaartmaatschappijen. SAF credits, gecategoriseed als 'Scope 1', kunnen niet worden gebruikt voor emissiereductieclaims van bedrijven en organisaties die gebruik maken van luchtvaart diensten.

  • Indien een bedrijf ervoor kiest 'scope 3 credits' te gebruiken voor het verminderen van zijn broeikasgasemissies (scope 3) of voor naleving van vrijwillige of gereguleerde emissiereductiedoelstellingen (zoals Science Based Targets), gebeurt dit volledig op eigen verantwoordelijkheid en risico.

Garanties en vrijwaring

  • Geen garantie voor gebruik: SAF Planet en zijn dochterondernemingen, agenten of partners doen geen uitspraken, garanties of toezeggingen over het gebruik van zijn diensten voor een specifiek doel.

  • Nauwkeurigheid van informatie: SAF Planet streeft naar het verstrekken van accurate en volledige informatie over SAF credits en diensten. Echter, als de Klant SAF credits deelt of gebruikt voor andere doeleinden, wijst SAF Planet aansprakelijkheid voor de nauwkeurigheid of geschiktheid van de verstrekte informatie af.

Beperking van aansprakelijkheid en vrijwaring

  • Vrijwaring: Voor zover wettelijk toegestaan, stemt de Klant ermee in om SAF Planet, haar functionarissen, werknemers en agenten te vrijwaren van claims, acties, verliezen of kosten voortvloeiend uit het gebruik van SAF credits of schending van deze Voorwaarden.

  • Beperking van aansprakelijkheid: SAF Planet is niet aansprakelijk voor indirecte, incidentele of gevolgschade, inclusief winstderving. De aansprakelijkheid is beperkt tot het bedrag dat door de Klant is betaald voor de betreffende SAF credits.

    Toepasselijk recht en geschillenbeslechting

    • In geval van een geschil moedigt SAF Planet mediation of arbitrage aan voordat gerechtelijke stappen worden ondernomen. Geschillen vallen onder de exclusieve jurisdictie van de rechtbanken Amersfoort of Utrecht (Rechtbanken Midden-Nederland), Nederland.
